1. Rental Agreement

1.1 All garments remain the property of Rental Archive at all times.

1.2 Customers are granted a temporary license to use the rented garment for the agreed rental period only.

1.3 Rental periods commence on the date the garment is delivered and conclude on the return date specified in your order confirmation.

1.4 Rental Archive reserves the right to refuse service, cancel orders, or decline rentals at its sole discretion.

2. Orders and Payment

2.1 Full payment must be received prior to dispatch.

2.2 Prices are displayed in Australian Dollars (AUD) unless otherwise stated.

2.3 Rental Archive reserves the right to amend pricing at any time without notice.

2.4 Orders are subject to availability and are not confirmed until you receive a confirmation email.

2.5 The individual garment's refundable security bond is collected upfront with the rental and any applicable delivery fee. Refunds are subject to return, inspection and these terms.

3. Delivery

3.1 Rental Archive uses third-party courier services for all deliveries.

3.1a Flat-rate shipping: $30 AUD Australia-wide. We currently only ship within Australia.

3.2 While every effort is made to ensure timely delivery, we do not guarantee delivery dates and are not liable for delays caused by:

• Courier delays

• Extreme weather events

• Natural disasters

• Industrial action

• Circumstances beyond our reasonable control

3.3 Customers are responsible for providing accurate shipping information. Rental Archive accepts no liability for orders delivered to incorrectly supplied addresses.

3.4 Risk and responsibility for the garment transfers to the customer upon confirmed delivery and remains with the customer until the garment has been returned and received by Rental Archive.

3.5 Signature-on-delivery may be required for selected orders.

4. Rental Period and Returns

4.1 Garments must be returned by the date specified in your order confirmation.

4.2 Customers must use the prepaid return packaging provided (where applicable).

4.3 Late returns may incur fees of:

• $15 per day for garments returned within seven (7) days of the due date.

• Full replacement costs where garments are not returned within fourteen (14) days.

4.4 Rental Archive reserves the right to charge any outstanding fees to the payment method used during checkout.

5. Garment Care

5.1 Customers agree to take reasonable care of all garments during the rental period.

5.2 Customers must not:

• Alter garments.

• Attempt repairs.

• Wash or dry clean garments unless expressly instructed.

• Use adhesives, dyes, or permanent products on garments.

5.3 Normal wear and tear is expected and does not include:

• Tears or rips.

• Permanent stains.

• Missing embellishments.

• Burns.

• Excessive stretching.

• Pet damage.

• Water damage.

• Odours caused by smoke or other substances.

6. Damages, Loss and Theft

6.1 Customers are fully responsible for all garments from the time of delivery until Rental Archive confirms receipt of the returned Item.

6.2 Rental Archive reserves the right to determine whether damage constitutes normal wear and tear.

6.3 If a garment is returned damaged, customers may be charged:

• Repair costs.

• Cleaning costs.

• Partial replacement costs.

• Full replacement costs where the garment is deemed beyond repair.

6.4 If a garment is lost, stolen, or not returned, customers agree to pay the full retail replacement value of the garment.

6.5 Rental Archive may retain all or part of any security bond to offset costs associated with damaged, lost, or stolen items.

7. Cleaning

7.1 Rental Archive professionally cleans garments between rentals.

7.2 Customers must return garments in the condition received, excluding reasonable wear.

7.3 Customers must not attempt to remove stains, as improper treatment may cause permanent damage.

8. Cancellations and Refunds

8.1 Cancellation requests submitted:

• More than fourteen (14) days before dispatch: Full refund.

• Seven (7) to fourteen (14) days before dispatch: Store credit only.

• Less than seven (7) days before dispatch: No refund.

8.2 Refunds will not be issued for:

• Change of mind.

• Failure to wear the garment.

• Incorrect sizing selected by the customer.

• Delays caused by third-party couriers.

8.3 In the unlikely event Rental Archive cannot fulfil an order, customers will receive a full refund or store credit at their election.

9. Security Bonds

9.1 Rental Archive may require a refundable security bond for selected garments.

9.2 Security bonds may be withheld where:

• Garments are returned late.

• Garments are damaged.

• Garments are not returned.

• Additional cleaning is required.

9.3 Security bond amounts will be determined at Rental Archive discretion.

The refundable security bond is payable upfront with your rental booking. Your bond will be refunded after the dress has been returned and inspected, provided it is returned in good condition and complies with our rental terms and conditions. If the dress is damaged, lost, or returned in a condition that breaches our policies, deductions may apply in accordance with our published terms.

9.4 Bonds are not refunded automatically on return. An authorised team member records an inspection and approves a full, partial or no refund under these terms. Approved refunds are made against the original Stripe payment, without refunding the rental or delivery fee through the bond refund action. Stripe confirmation does not guarantee funds have already reached your bank.

10. Customer Conduct

Customers agree not to:

• Use the website unlawfully.

• Engage in fraudulent transactions.

• Misrepresent their identity.

• Interfere with the operation or security of the website.

Rental Archive reserves the right to refuse future rentals where these Terms have been breached.

11. Privacy

11.1 Rental Archive collects personal information in accordance with its Privacy Policy.

11.2 By using the website, you consent to the collection and use of your information for:

• Processing orders.

• Customer support.

• Marketing communications (where consent has been provided).

• Fraud prevention.

12. Limitation of Liability

12.1 To the fullest extent permitted by law, Rental Archive shall not be liable for:

• Indirect or consequential losses.

• Loss of profits or opportunities.

• Delayed deliveries.

• Events beyond our reasonable control.

12.2 Rental Archive total liability in relation to any claim shall not exceed the amount paid by the customer for the relevant rental transaction.

12.3 Nothing in these Terms excludes rights that cannot be excluded under Australian Consumer Law.

13. Australian Consumer Law

13.1 These Terms are subject to applicable Australian Consumer Law.

13.2 Nothing in these Terms excludes, restricts, or modifies any consumer guarantees or rights available under Australian legislation.

14. Amendments

Rental Archive reserves the right to amend these Terms at any time. Updated Terms will be published on our website and become effective immediately upon publication.

15. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria.
